MINE HEALTH AND SAFETY ACT 29 OF 1996 SECTION 23

The employee has the right to leave the working place if:

  • The employee has reasonable justification for believing that the conditions in working place pose a serious danger to health and safety
  • The health and safety representative for that workings place directs the employee to leave the working place.
  • The employer must consult with the health and safety committee and determine a procedure to effectively allow for the exercise of the employee’s right. This procedure must provide for:
  • The notification of the health and safety representative and supervisor of the believed dangerous place
  • Management and representative participation in reaching resolution on any issues that may areas from exercising this right
  • Involvement of an inspector or advisor where necessary
